What is a “No-Fault” State?
There can be many different expenses covered by no-fault automobile accidents. New York is one of a number of states that is considered a “No-Fault” state. This means that after a motor vehicle accident, an injured person’s own insurance company pays for medical treatment. They will also cover other out-of-pocket expenses incurred as a result of the accident. As such, you will likely be entitled to certain benefits through your No-Fault Insurance. This is the case if you are an operator, passenger, or pedestrian injured in a motor vehicle accident.
Basic No-Fault auto insurance coverage includes:
- Reasonable and necessary accident related medical and rehabilitation expenses;
- 80% of lost earnings from work, up to a maximum payment of $2,000 per month for up to three years from the date of the accident;
- Up to $25 a day, for up to a year from the date of the accident, to reimburse other reasonable and necessary expenses (ex. transportation expenses to and from medical treatment, household help) resulting from the accident;
- A $2,000 death benefit (in addition to the $50,000 basic No-Fault limit), payable to the estate of a person eligible for No-Fault benefits who was killed in an auto accident.
An insured must apply for No-Fault benefits no later than 30 days after the accident. It is imperative to submit the application prior to this deadline to ensure you receive any benefits you may be entitled to.
